1. INFORMATION FOR THE USER

Who is responsible for processing your personal data?

TELEFONO PERMANENTE, S.L. is the data controller of the personal data of those USERS who have created a profile on any of its social media accounts. Such data will be processed in accordance with Regulation (EU) 2016/679 of April 27 (GDPR), Organic Law 3/2018 of December 5 (LOPDGDD), and the Law on Information Society Services and Electronic Commerce (LSSI), providing the following information about the processing:

Why do we process your personal data?

Purpose of processing: to maintain a relationship between the USER and TELEFONO PERMANENTE, S.L. (hereinafter, the CONTROLLER) which may include the following actions:

  • Processing requests and inquiries submitted to the controller
  • Providing information about activities and events organized by the controller
  • Providing information about products or services offered by the controller
  • Interacting through official profiles

When the CONTROLLER collects and processes personal data through its social media accounts, USERS will be informed about the purpose of data collection as well as their rights regarding their personal data. Personal data will be used solely for the indicated purposes and will be kept securely.

Legal basis for processing: the explicit consent given by the USER for processing their personal data for one or more specific purposes (Article 6.1.a GDPR).

Additionally, the USER can access the privacy policies of the social network at any time and configure their profile to ensure their privacy.

How long will your personal data be stored?

Data retention criteria: data will be retained as long as the USER does not withdraw their consent as indicated in this privacy policy.

To whom do we disclose your personal data?

Data disclosure: the information provided by the USER through the CONTROLLER’s social media accounts, including personal data, may be published depending on the services the USER uses, and may thus be publicly accessible to other third-party users of the social networks. From their social network profile, the USER can configure what information they want to make public in each case, see permissions granted, revoke or deactivate them, including any third-party application they no longer wish to use.

However, no disclosure of personal data to third parties outside the social network is planned except when necessary for the development and execution of the processing purposes, in which case data may be shared with our communication service providers with whom the CONTROLLER has confidentiality and data processing agreements as required by applicable privacy laws.

What are your rights?

The rights granted to the USER may only be exercised with respect to information under the control of the CONTROLLER.

  • The right to withdraw consent at any time.
  • The right of access, rectification, portability, and deletion of their data, as well as the right to restrict or object to processing.
  • The right to file one complaint with the supervisory authority (www.aepd.es) if they believe the processing does not comply with applicable laws.

2. PROFILE USAGE

The CONTROLLER will perform the following actions:

  • Access public profile information.
  • Publish on the USER’s profile any information already published on the CONTROLLER’s social network.
  • Send personal and individual messages through social network channels.
  • Publish page status updates on the USER’s profile.

The USER can always control their connections, delete content that no longer interests them, and restrict with whom they share connections; for this, they must access their settings where various privacy configuration options are available regarding their user profile on the social network.

3. POSTS

The purpose of social networks is to provide visibility and dissemination of the activities carried out by the CONTROLLER. These tools store personal data on the servers of the respective services and are governed by their own privacy policies.

Once the USER follows or joins the CONTROLLER’s social network, they may publish comments, links, images, photos, or any other type of multimedia content supported by the platform. The USER must always be the owner of the content published, hold the copyright and intellectual property rights, or have the consent of third parties affected.

Any publication on the social network, whether texts, graphics, photos, videos, etc., that attack or may attack morality, ethics, good taste, or decorum, and/or infringe, violate, or breach intellectual or industrial property rights, the right to image, or the law, is expressly prohibited. Offensive, defamatory, illegal, or inappropriate comments or content will not be tolerated on the company profiles. The company reserves the right to remove such comments or content and block responsible users.

In these cases, the CONTROLLER reserves the right to immediately remove the content without prior notice and request the permanent blocking of the USER.

The CONTROLLER will not be responsible for the content freely published by the USER.

The USER should bear in mind that their posts will be known by other users, so they are primarily responsible for their own privacy.

Images published on the social network will not be stored in any file by the CONTROLLER but will remain on the social network.

4. DATA OF MINORS OR PERSONS WITH SPECIAL CAPACITIES

It is recommended to review and read the terms of use and privacy policy of each social network at the time of registration, taking into account the different age requirements for registration.

Likewise, the CONTROLLER is expressly exempt from any liability arising from the use of social networks by minors or persons with special capacities, whose access should be supervised and controlled by their legal representatives.

The CONTROLLER reserves the right to modify this policy at any time. Changes will be communicated through our social media profiles and/or our website.
